3. Scope of Use—Propranolol Only

• Any such use constitutes a material breach of these Terms

Telehealth Partners

Telehealth providers are independent healthcare entities—not our employees, agents, or representatives. We do not control their medical care, guarantee their services, or accept responsibility for their prescriptions or advice. Your relationship with them is between you and them.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROPRANOLOLGUIDE.ORG, ITS OWNERS, OPERATORS, AFFILIATES, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES; PERSONAL INJURY OR PROPERTY DAMAGE.

This includes damages arising from your use or inability to use the Service; any content or information obtained through the Service; any decisions made based on information from the Service; any health outcomes, adverse events, or medical emergencies; any application of output to medications other than propranolol; any misuse of the Service; any third-party services; or any interruption of the Service.

Damage Cap

IF WE ARE FOUND LIABLE FOR ANY DAMAGES, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF ONE HUNDRED EURO (€100.00) OR THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless PropranololGuide.org from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from your use of the Service; your violation of these Terms; your violation of any law or third-party rights; any content you provide; any application of output to medications other than propranolol; or any misuse of the Service.

13. Safety Exception and Reporting

Our Right to Report

Notwithstanding any other provision, we reserve the right to disclose your information to appropriate authorities if we reasonably believe disclosure is necessary to prevent imminent harm to you or any other person; respond to a credible threat of self-harm or suicide; respond to a credible threat of harm to others; comply with legal requirements; or protect rights, property, or safety.

No Monitoring Obligation

We do not actively monitor user activity for signs of crisis or self-harm. If you are in crisis, please use the crisis resources provided in our Medical Disclaimer.

14. Dispute Resolution and Arbitration

Informal Resolution First

Before filing any legal claim, you agree to attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 60 days.

Binding Arbitration

Except for disputes described in "Exceptions" below, you and PropranololGuide.org agree to resolve any disputes through mediation first, then binding arbitration if mediation is unsuccessful. Any arbitration shall be administered in accordance with the Arbitration Act 2010 (Ireland), or you may elect to proceed through the courts of Ireland.

Arbitration Costs

For claims under €10,000, we will pay reasonable arbitration or mediation fees. For larger claims, fees will be allocated as determined by the arbitrator or mediator.

Exceptions to Arbitration

The following are not subject to arbitration: claims in small claims court; claims for injunctive relief to protect intellectual property; claims that cannot legally be arbitrated.

Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of your first use of the Service.

15. Class Action Waiver

YOU AND PROPRANOLOLGUIDE.ORG AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

You waive any right to bring or participate in class actions, class arbitrations, private attorney general actions, or any representative or consolidated proceeding.

16. Governing Law and Jurisdiction

These Terms will be governed by the laws of the laws of Ireland, without regard to conflict of law principles. For claims not subject to arbitration, you consent to the exclusive jurisdiction of courts of the Republic of Ireland.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by posting updated Terms with a new "Last Updated" date and, where possible, email notification. Your continued use after any modification constitutes acceptance.

18. Termination

Termination by You

You may stop using the Service at any time.

Termination by Us

We may suspend or terminate your access at any time, with or without cause, with or without notice.

Effect of Termination

Upon termination, your license terminates immediately, and all provisions that should survive termination will survive.

19. Severability

If any provision is found invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary or severed. The remaining provisions continue in full force.

20. Entire Agreement

These Terms, together with the Medical Disclaimer, Privacy Policy, and DMCA/Copyright Policy, constitute the entire agreement between you and PropranololGuide.org.
